Overview
Sale and distribution of fireworks from a tent, stand or building is regulated by the Kansas State Fire Marshal's Office. The Garden City Fire Department, along with the Garden City Building Department and Finney County follow the requirements of sales dates as outlined by the State of Kansas or by special ordinance if adopted. Fireworks can only be sold or distributed in Finney County and are not allowed to be sold within the corporate boundaries of the City of Garden City. Sky Lanterns and Bottle Rockets are banned from sale, distribution or possession by local ordinance and state statute.
Permits
A permit is required to sell and distribute 1.4g consumer grade fireworks to the public. This permit must be signed by the Garden City Fire Department, the Garden City Building Department and Finney County. The cost of the permit and permit applications can be obtained through the Finney County website. Items required with the permit application are:
- Site Plan showing location of tent, stand or building with North arrow and closest buildings. Site plan needs to show storage locations of fireworks if on site.
- Commercial Liability Insurance.
- Fire Retardant Certification for Tents. Certification number must match for the tent being used.
Inspections
The Garden City Office of the Fire Marshal will inspect all fireworks tents, stands and buildings in accordance with Kansas State Regulations and NFPA 1124 (Code for the Manufacture, Transportation, Storage, and Retail Sales of Fireworks and Pyrotechnic Articles). Inspections are required to be completed before the tent, stand or building is open for business, to allow for correction of any infractions as required by Code. Inspection requirements are as follows:
- Proper amount of fire extinguishers including at least one 2.5 gallon water extinguisher.
- Proper travel distances to extinguishers not to exceed 75 feet.
- No Smoking Signs
- Parking no less than 10 feet from the tent, stand or building.
- Signage stating (No Discharge of Fireworks within 300 feet) of tent, stand or building.
- Two means of egress and one emergency egress area.
- Emergency egress lighting for tents and building over 800 square feet.
- Exit openings at least 44 inches in width. Aisles at least 36 inches in width.
- Proper storage of fireworks
- Electrical cords rated for proper use.
- Power generators located at least 20 feet from tent, stand or building.
